Acceptance
By accessing or using RateMyCollegeCounselor (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to submit a review. By creating an account you confirm you meet these requirements.
Your account
You are responsible for activity on your account and for keeping your password secure. One person, one account. Do not share or sell access. Notify us at ratemycollegecounselor@gmail.com if you suspect unauthorized use.
Reviews and other content you submit
You retain ownership of what you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your submissions in connection with operating and promoting the Service.
You represent that everything you post is your own first-hand experience, factually accurate to the best of your knowledge, and not paid, solicited, or written on behalf of anyone else. Do not submit content you have a financial conflict of interest in (yours, a competitor’s, an employer’s).
Prohibited content
You may not post content that:
- is false, defamatory, or that you cannot reasonably support;
- identifies a minor by name, school, or photograph;
- discloses private information (home address, phone, finances, medical details) about anyone;
- harasses, threatens, or targets a person on the basis of a protected characteristic;
- infringes copyright, trademark, or other rights;
- is spam, automated, or designed to manipulate ratings;
- impersonates anyone or misrepresents your relationship to a counselor.
Moderation
We may, at our sole discretion and without notice, edit, remove, or refuse to publish any submission, suspend or terminate any account, or restrict access to the Service. We are not obligated to monitor content but may do so.
Reporting and takedown
If you believe content on the Service is defamatory, infringes your rights, or otherwise violates these Terms, please see our report page or email ratemycollegecounselor@gmail.com. Include the URL of the content, your contact information, and a clear description of the issue. For copyright claims under the DMCA, your notice must comply with 17 U.S.C. § 512(c)(3).
Counselors listed on the Service
Counselors are listed because users have submitted them. We do not endorse, employ, or have a business relationship with any listed counselor. A counselor or agency may request removal of their listing or correction of factual information by emailing ratemycollegecounselor@gmail.com; opinions in reviews will not be removed solely because the subject disagrees with them.
No professional advice
Reviews are personal opinions of individual users, not professional advice. We make no representation that any counselor is qualified, available, or suitable for your needs. Do your own due diligence before hiring anyone.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or in connection with your use of the Service. Our aggregate liability for any claim is limited to one hundred U.S. dollars (US$100).
Indemnification
You will indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your violation of these Terms.
Termination
You may close your account at any time by emailing ratemycollegecounselor@gmail.com. We may suspend or terminate your access at any time, with or without notice, for any reason. Sections that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction of the state and federal courts located there for any dispute that is not subject to binding arbitration where required by law.
Changes
We may update these Terms from time to time. If a change is material, we will update the “Last updated” date and, where appropriate, give additional notice. Continued use of the Service after changes take effect means you accept them.
